EightPass LLC (“EightPass,” “we,” “us,” or “our”) respects your privacy. Important definitions: For purposes of this Privacy Policy, “promotional entries” are entries that may be obtained through no-purchase methods, such as AMOE, and, where offered, as an added promotional benefit with optional purchases of eligible digital products, such as digital artwork, artwork packs, collector releases, creative assets, or other digital products, as described in the applicable Official Rules and Giveaway Details. Promotional entries have no cash value and are used solely to participate in eligible Giveaways on the Services.

We may update this Privacy Policy from time to time to reflect changes in our practices, operational needs, legal requirements, or the Services. We will update the “Last Updated” date above when we do.
Your continued use of the Services after changes become effective constitutes acceptance of the updated Privacy Policy.

A) Information You Provide Directly

AMOE / mail-in entry information, such as full legal name, mailing address, email address, phone number, date of birth, state of residence, Giveaway title, and other information included with an AMOE request.
Communications preferences, such as email, SMS, or marketing preferences where applicable.
B) Information Collected Automatically
When you use the Services, we may automatically collect:
Device and network information, such as IP address, browser type, operating system, device identifiers, device type, language settings, and approximate location derived from IP address.

detect, investigate, prevent, and address fraud, abuse, chargebacks, duplicate account abuse, automated activity, security incidents, or violations of our Terms or Official Rules;
maintain records, logs, audit trails, and compliance documentation;
comply with legal, tax, regulatory, payment, accounting, and record-keeping obligations; and
enforce our Terms of Service, Official Rules, policies, and legal rights.
6) How We Share Information
We may share information with:
Service providers that perform services for us, such as payment processing, hosting, analytics, fraud prevention, security, email/SMS delivery, customer support, digital delivery, logging, and technical operations. These service providers may access information only as needed to provide services to us.
Payment processors and commerce partners to process payments, verify transactions, handle refunds, manage chargebacks, and prevent fraud.
Prize and logistics partners to verify, fulfill, and deliver prizes, such as shipping carriers, digital gift card providers, code providers, verification providers, or prize fulfillment vendors.
Legal, compliance, and safety recipients where required by law, subpoena, court order, governmental request, tax requirement, or where we believe disclosure is necessary to protect rights, property, safety, users, the Services, or the integrity of any Giveaway.
Business transfer recipients in connection with a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar business transaction, subject to applicable law.
We do not sell your personal information for money. If applicable law treats certain analytics, advertising, or similar disclosures as a “sale” or “sharing,” we will provide any required opt-out mechanism.
SMS opt-in data, if applicable: We do not sell SMS opt-in consent data, and we do not share SMS opt-in consent with third parties for their own marketing.
7) Data Retention
We retain information for as long as reasonably necessary to provide the Services, maintain your account, administer Giveaways, process transactions, deliver digital products, verify eligibility, fulfill prizes, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, and maintain appropriate business records.
Mail-In AMOE Entry Records: If you submit an AMOE or other mail-in entry, we may digitize, scan, or photograph the mailed materials and store the digitized record securely for administration, verification, fraud prevention, audit, and legal compliance purposes. After digitization, the physical mailed materials are destroyed, such as by secure shredding or another irreversible destruction method, within a reasonable period.
We generally retain digitized AMOE records for twenty-four (24) months after the end of the applicable Giveaway, unless a longer retention period is required by law, tax obligations, dispute resolution, fraud prevention, or legal compliance.
Where appropriate, we may anonymize or aggregate information so it no longer identifies you.
8) Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure.
However, no method of transmission over the internet or method of electronic storage is 100% secure. We cannot guarantee absolute security.
You are responsible for maintaining the confidentiality of your account credentials and for using secure devices and networks when accessing the Services.
9) Your Rights and Choices
Depending on your location and applicable law, you may have rights to:
access or request a copy of certain information;
request correction of inaccurate information;
request deletion of certain information, subject to legal exceptions;
object to or restrict certain processing;
opt out of marketing communications;

Marketing opt-out: You may opt out of marketing emails using the “unsubscribe” link in the email or by contacting us. You may opt out of SMS messages, if applicable, by replying STOP or using any other opt-out method provided.

We may deny or limit requests where permitted or required by law, including where information must be retained for legal, tax, security, fraud prevention, dispute resolution, or Giveaway administration purposes.
10) Do Not Track and Global Privacy Controls
Some browsers transmit “Do Not Track” signals. Because there is no consistent industry standard for Do Not Track, our systems do not currently respond to those signals.
Where required by applicable law, we will honor legally recognized opt-out preference signals, such as Global Privacy Control, for applicable sale, sharing, or targeted advertising opt-outs.
11) Children’s Privacy
The Services are not intended for anyone under eighteen (18) years of age, and we do not knowingly collect personal information from anyone under 18.
If we learn that we collected personal information from a person under 18 in violation of applicable law, we will take reasonable steps to delete it.

The Services are operated from the United States. If you access the Services from outside the United States, you understand that information may be transferred to, stored in, and processed in the United States and other jurisdictions where our service providers operate.
